Scholarship in law (la doctrine) plays a more important role in the civil law tradition than in the common law tradition given the existence of a code, the formal style of judgment writing and the pervasiveness of the view of law as legal science Since the late eighteenth century, civil law scholarship in Quebec has gone through at least six phases, but only now does it seem to be emerging from the inward-looking didactic posture it has maintained since the turn of the twentieth century....

Legal scholarship must be related to legal education, so that teaching does not reflect only one aspect of legal training, whether it be black-letter law, clinical training, or feeble attempts to graft on bits of other disciplines. Instead, students must be exposed to a true synthesis of law and other disciplines and areas of learning. This will require a serious reconsideration of teaching methods, preparation of teaching materials, and ways of testing law students. Academic law should not...

The proposition that event taxonomies have a "basic" level was tested. In the first two tasks of the experiment, taxonomically related event categories were elicited. Nine taxonomies were constructed from subjects’ responses on these tasks. In the third task, subjects listed attributes for events categories from the three levels of abstraction of these taxonomies. A single, common level of abstraction (the basic level) was identified. Subjects listed significantly more attributes for basic...

All professions are dependent to some degree on their corpus of literature. For several reasons this dependency is especially acute for the legal profession. First, a large part of legal literature is “authoritative” in a sense different from the literature of, say, medicine or history. " In this article I want to trace the development of the treatise tradition in the common law system, and build on an idea suggested but not fully developed by Schulz's study of the literary activity of the ancient Roman lawyers: the close relation between the forms of legal literature and lawyers' ideas of what they are doing, and of the appropriate way for jurists to behave. More radically, I shall suggest that certain literary forms are closely tied to theories about the nature of law itself, and that this is particularly true of the treatise." (extrait, p. 633)

For over a century, writers have had the benefit of using Roget's Thesaurus for literary composition. During that time other thesauri have been prepared, but members of the legal profession never had a thesaurus to assist them in their professional work. To the members of the judiciary, clear and precise language is not only important, it is mandatory. Every word that is written is subject to close scrutiny and interpretation. These words become precedents and shape the future development...
